Terms and Conditions of Sale

Placing orders

Please place all orders in writing, either by letter or email. Orders that are not confirmed in writing will be processed at our discretion. Orders will be acknowledged by us in writing. We cannot accept responsibility for any errors not reported to us in writing before the order is dispatched. All items are subject to availability at the time the order is received. The sizes listed are for guidance only and may vary with the growing season. Prices quoted are subject to VAT where applicable and may change without notice. We reserve the right to adjust delivery charges due to fluctuating fuel and haulier rates. Fuel surcharges may apply.

Payment

100% of the invoice must be paid before collection or dispatch. If a credit facility has been arranged, the full payment is due within 28 days from the date of the invoice. A charge of 3.5% above the Bank of England base rate can be added per month at the discretion of Rymer Trees and Hedging for any late payments, added cumulatively, starting 29 days from the date of the invoice.

Deposit

A deposit for goods being held or grown specifically may be required at the discretion of Rymer Trees and Hedging. Where a deposit is required please make payment within 5 working days of receiving the sales confirmation email or risk voiding the order

Delays and cancellations

If an order is cancelled, whether partially or entirely, Cheviot Trees Ltd. retains the right to impose charges of up to 100% of the order value and costs resulting from the cancellation or rescheduling of the order. Any surplus stock or materials bought cannot be returned for credit without prior arrangement, and a handling fee may be applicable.

Unforeseeable circumstances

Rymer Trees and Hedging will not be responsible for any claims related to its inability to supply, when such failure is due to climatic conditions, natural events, accidents, or any other causes beyond our control.

Liability

While we strive to provide stock of the highest quality, we do not guarantee the description, quality, growth, or productivity of the products. We will make every effort to fulfil orders to our customers' satisfaction, but we cannot promise completion by a specific date and will not accept claims for any resulting losses. The Company is not responsible for any loss or damage resulting from the use of provided information. In all instances, the Company’s liability is limited to replacing faulty items or, at our discretion, offering a credit not exceeding the value of the order in question. We do not accept liability for consequential losses.

Complaints

We will assume the delivery has been accepted if we do not receive feedback within 7 days of the receipt of goods. Any complaints made after the 7 days will be dealt with at the discretion of Rymer Trees and Hedging.
