The terms on which we supply trees, hedging and accessories
Rymer Trees and Hedging is the trading name of Rymer Trees Ltd, registered in England and Wales (Company No. 13353761). Our registered address is Rymer Farm, Barnham, Thetford, Suffolk, IP24 2PP.
References to "we", "us" and "our" in these terms refer to Rymer Trees Ltd.
All orders are subject to availability and acceptance by us. We reserve the right to decline any order at our discretion. An order is only confirmed once we have provided written confirmation (typically by email).
Prices quoted are subject to change until an order is confirmed in writing. We reserve the right to correct any pricing errors prior to confirmation.
Minimum order quantities may apply and will be communicated at the time of enquiry.
All prices on our website are retail prices and include VAT at the current rate, unless stated otherwise. Wholesale customers should contact us or log in to their wholesale account for applicable pricing.
Payment terms will be agreed at the time of order confirmation. We reserve the right to require payment in full or in part prior to despatch for new customers or large orders.
Late payment may result in orders being held or cancelled. We reserve the right to charge statutory interest on overdue invoices in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
We will agree a delivery date with you at the time of order. While we make every effort to meet agreed delivery dates, we cannot guarantee delivery on a specific date and shall not be liable for any loss arising from delivery delays outside our reasonable control.
Delivery charges, if applicable, will be communicated prior to order confirmation. Risk in the goods passes to you upon delivery.
It is your responsibility to ensure adequate arrangements are in place to receive and store the trees on the agreed delivery date. If a delivery cannot be completed due to circumstances on your end, re-delivery charges may apply.
We take great care to supply healthy, well-grown stock that meets our Plant Healthy (PHCS 0041) and UKISG certification standards. All stock is peat-free and cell-grown unless otherwise stated.
Trees are living organisms and natural variation in size, shape and appearance is to be expected. Images on our website are illustrative only.
Species, sizes and specifications are subject to availability. Where a specific item is unavailable, we will contact you to discuss alternatives.
You must inspect goods upon delivery and notify us in writing of any damage, defect or shortfall within 48 hours of receipt. Failure to do so may affect your ability to make a claim.
Photographic evidence of any damaged or defective stock should be provided where possible. We will assess claims on a case-by-case basis and may offer replacement stock, a credit or a refund at our discretion.
We are not liable for losses arising from poor planting practice, inadequate aftercare, unsuitable site conditions, drought, flooding, pest damage or other factors outside our control once goods have been delivered.
Orders cancelled after confirmation may be subject to a cancellation charge, particularly where stock has been reserved or grown specifically for your order.
Due to the perishable nature of live plant material, we are unable to accept returns of stock that has left our nursery unless it is defective or damaged on arrival.
If you are a consumer (ordering for personal, non-business use), you may have additional rights under the Consumer Contracts Regulations 2013. Please contact us to discuss.
Our liability to you shall not exceed the value of the goods supplied under the relevant order. We shall not be liable for any indirect, consequential or economic loss, including but not limited to loss of profit, loss of planting grants, or costs of replanting.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
All stock is produced and supplied in accordance with our Plant Healthy certification (PHCS 0041). You agree to handle and plant stock in a manner consistent with good biosecurity practice.
If you become aware of any plant health concerns with stock supplied by us, please notify us immediately so that we can investigate and, if necessary, inform the relevant authorities.

These terms are governed by the laws of England and Wales. Any disputes arising from them shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We may update these terms from time to time. The version published on our website at the time of your order will apply to that order.
